SalesArcade Terms of Service

These Terms of Service ("Terms") are an agreement between you and Deox, Inc., a Delaware corporation ("DEOX", "we", "us"), and govern your use of the SalesArcade: Learn to Sell mobile app ("SalesArcade" or the "App"). By downloading or using SalesArcade you agree to these Terms. If you do not agree, do not use the App.

1. Your license to use SalesArcade

We grant you a personal, non-exclusive, non-transferable, revocable license to use SalesArcade for your own learning on devices you own or control, in line with these Terms and the rules of the app store you downloaded it from. You must be at least 13 years old, or the minimum age required in your country, to use SalesArcade.

2. SalesArcade Pro subscriptions

  • Plans: full access to SalesArcade requires a SalesArcade Pro subscription, offered as a weekly, monthly or yearly plan. Current prices are shown in the App before you buy (in the US: $5.99 per week, $9.99 per month or $49.99 per year) and may vary by country and include applicable taxes.

  • Payment: payment is charged to your Apple ID or Google Play account when you confirm the purchase.

  • Automatic renewal: your subscription renews automatically at the same price and for the same period unless you cancel it at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.

  • Cancelling: you can cancel anytime in SalesArcade under Settings → Subscription, or in your Apple ID settings or the Google Play Store. Cancellation takes effect at the end of the current period, and you keep access until then. Deleting the App does not cancel your subscription.

  • Free trials: if a free trial is offered, it converts to a paid subscription when it ends unless you cancel at least 24 hours before the trial ends. Any unused part of a trial is forfeited when you buy a subscription.

  • Special offers: we may sometimes offer a discount, for example a one-time discount on your next billing period when you start to cancel. An offer applies only to the plan, price and number of billing periods shown when you accept it. After that, your subscription renews at the regular price unless you cancel. Each offer can be used once and can't be combined with other offers.

  • Price changes: if we change subscription prices, Apple or Google will notify you in advance as their rules require, and where required you will be asked to agree before the new price applies.

  • Refunds: purchases are processed by Apple or Google and are subject to their refund policies. To request a refund, contact Apple (reportaproblem.apple.com) or Google Play. We cannot issue refunds directly.

  • Restoring: you can restore an active subscription on a new device signed in to the same Apple ID or Google account by tapping Restore purchases.

3. Training content, and no guarantee of results

SalesArcade provides educational sales training: lessons, simulations, objection and negotiation exercises, scripts, flashcards and call breakdowns. All call breakdowns, simulations and examples are fictional reenactments written for training. Any resemblance to real people or companies is coincidental.

SalesArcade is for general education only. It is not legal, financial, tax or other professional advice, and we do not guarantee any particular sales result, income or career outcome. Skill scores, levels and rankings are estimates designed to guide your practice.

If you use SalesArcade's scripts or techniques in real outreach, you are responsible for following the laws and rules that apply to you. These include telemarketing and do-not-call rules, email and messaging laws (such as the TCPA and CAN-SPAM in the US), consumer-protection and privacy laws, and your employer's policies.

4. Acceptable use

You agree not to: copy, modify, distribute, sell or rent the App or its content; reverse engineer or attempt to extract the App's source code or content, except where the law allows; bypass or interfere with the App's subscription or security features; use the App to build a competing product; or use the App in any unlawful way.

5. Your content

Notes, answers and scripts you write or customise in SalesArcade stay on your device and remain yours. You are responsible for what you create and how you use it.

When you share a progress card or other content from SalesArcade, you choose where it goes and are responsible for what you post. Please don't share content in a way that suggests DEOX endorses you or your company.

6. Ownership

SalesArcade, including its software, design, text, lessons, scenarios, scripts and branding, is owned by DEOX or its licensors and is protected by intellectual-property laws. Except for the license in section 1, these Terms do not give you any rights to it.

7. Privacy

Our Privacy Policy explains how we handle information and is part of these Terms.

8. Changes and availability

We may update, change or discontinue SalesArcade or any part of it, and we may update these Terms. If we make material changes to the Terms, we will update the effective date and let you know in the App. If you continue using SalesArcade after changes take effect, you accept the updated Terms.

9. Disclaimer

To the fullest extent permitted by law, SalesArcade is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that its content is complete, accurate or up to date.

10. Limitation of liability

To the fullest extent permitted by law, DEOX will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunities, arising from your use of SalesArcade. Our total liability for any claim relating to SalesArcade is limited to the amount you paid for SalesArcade in the 12 months before the claim. Nothing in these Terms limits rights you have as a consumer that cannot be waived or limited under the law that applies to you.

11. Termination

You can stop using SalesArcade at any time by cancelling any subscription and deleting the App. We may suspend or end your license if you seriously or repeatedly breach these Terms. Sections 3, 6, 9, 10 and 12 survive termination.

12. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, except where the law of your country of residence gives you mandatory consumer protections.

13. Apple App Store additional terms

If you downloaded SalesArcade from Apple's App Store:

  • These Terms are between you and DEOX only, not Apple. DEOX, not Apple, is solely responsible for SalesArcade and its content.

  • Your license is limited to using SalesArcade on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

  • Apple has no obligation to provide maintenance or support for SalesArcade.

  • If SalesArcade fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding SalesArcade.

  • DEOX, not Apple, is responsible for addressing any claims relating to SalesArcade or your use of it, including product-liability claims, claims that SalesArcade fails to meet legal or regulatory requirements, and consumer-protection, privacy or similar claims.

  • If a third party claims that SalesArcade or your use of it infringes their intellectual-property rights, DEOX, not Apple, is responsible for investigating, defending, settling and discharging that claim.

  • You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.

  • You must comply with any applicable third-party terms when using SalesArcade.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Google Play

If you downloaded SalesArcade from Google Play, your purchases are also subject to the Google Play Terms of Service.
